Which records and offices are covered?
| Record or recipient | Published mechanism | Important limit |
|---|---|---|
| Property appraiser or tax collector | Remove protected names and official-record locators under section 119.071(4)(d). | An unassociated street address or legal description can remain public. [1] |
| Other agency custodian | Submit the written, notarized statutory request to each holding agency. | The request must identify the exemption and confirm the applicant's eligibility. [3] |
| Voter registration | The Division of Elections distinguishes ACP participants and statutory high-risk groups. | Ordinary voter information remains public subject to specified exceptions. [4] [5] |
| Address Confidentiality Program | File the prescribed application with the Attorney General. | Dating violence, domestic violence and the separate stalking provision have their own conditions. [6] [7] |
| Covered commercial controller | The Digital Bill of Rights provides a qualified deletion right. | The controller definition includes a revenue threshold above $1 billion and listed business-model conditions. [8] [9] |
Why can the parcel address remain visible?
Section 119.071(4)(d) contains 26 separate category paragraphs. Those paragraphs distinguish current and former personnel, family members and particular personal information. The categories do not create identical protection for every public employee. A qualifying law-enforcement officer, judicial employee or other listed person must use the paragraph that actually covers the requested information. [2]
The property rule focuses on the connection between protected identity information and the home. The property appraiser or tax collector removes the protected name and specified record locator. The statute preserves a street address or legal description when it is not associated with exempt information. A visible parcel therefore does not alone establish that the custodian ignored the exemption. [1]
Which request reaches the relevant custodian?
For a custodian other than the person's employer, the reviewed provision requires a written, notarized request. The request states the statutory basis, confirms eligibility and identifies the information. Sending one request to a county office does not establish receipt by another agency. The statutory request is tied to the custodian holding the records. [3]
The current statute also preserves particular professional access and conveyance rules. The residence exemption for an official record can end after the property is conveyed under the specified conditions. Some category paragraphs contain different legislative review dates. The judicial and agriculture clauses, for example, identify October 2, 2028. Those dates require category-level checking rather than a single statewide expiration assumption. [10] [2]
How do voter privacy and broker requests differ?
The Division of Elections describes ordinary voter registration information as public, with exceptions. It separately identifies Address Confidentiality Program participants and specified high-risk groups. The agency's guidance calls for written requests to agencies holding covered information. ACP applications go to the Attorney General. Neither route should be described as an automatic deletion of every existing county record. [5] [4] [11] [6]
Commercial data requests raise another scope question. Florida's Digital Bill of Rights includes a deletion right for covered controllers, but section 501.702 defines a limited controller class. Its personal-data definition also excludes publicly available information. A consumer should check both the business's applicability conditions and the source of the data before treating a request as enforceable under this law. [8] [9] [12] [13]
