Which records and offices are covered?
| Record or recipient | Published mechanism | Important limit |
|---|---|---|
| Appraisal district | Elect confidentiality under Tax Code 25.025 using the prescribed form. | File with each holding district; property can remain searchable by address without identifying the protected person. [3] [4] |
| Judicial notification | Specified judges and spouses have an Office of Court Administration route. | The statutory judicial notification differs from the ordinary form election. [3] |
| Voter registration | Submit the reviewed confidentiality form to the County Voter Registrar. | Election Code categories govern this request independently. [5] [6] |
| ACP participant | Certification is a listed qualification for the separate appraisal election. | ACP does not itself establish blanket deed or parcel confidentiality. [7] |
| Commercial data controller | Chapter 541 provides deletion and specified opt-out rights. | The authorized-agent provision concerns the identified opt-out rights and verification conditions. [8] [9] |
What does the appraisal election actually conceal?
Tax Code 25.025 identifies 37 qualifying categories in the current code. The reviewed Comptroller form is older and contains fewer categories. Its printed checklist therefore cannot substitute for the current statutory definition. The mechanism concerns information in appraisal records that identifies the protected person's home address. It should not be described as an election covering every county record or private website. [2] [1]
The statutory limit is particularly important for property searches. An appraisal district can disclose information identifying property by address when it does not identify the electing individual in connection with that address. The parcel can remain visible while the protected identity link is withheld. The law also preserves specified official uses by appraisal, state, taxing and political-subdivision bodies. [4] [1]
Which office receives each request?
The ordinary appraisal election uses the Comptroller-prescribed form with each appraisal district holding the information. Specified judges and their spouses have a separate Office of Court Administration notification mechanism. The election remains valid until the individual rescinds it in writing. A reader should keep the district's receipt and the judicial notification route distinct when checking whether the relevant custodian received the request. [3] [10]
ACP certification is itself one qualification for the separate section 25.025 election. The Attorney General's program permits applications with an advocate or independently, with online or mail submission. Certification and appraisal suppression are different events. Voting uses another recipient. The reviewed election confidentiality form directs qualifying applicants to the County Voter Registrar's Office and describes written rescission of the election protection. [7] [11] [6] [5]
How do commercial deletion and broker registration differ?
Business and Commerce Code 541.051 includes deletion of personal data provided by or obtained about the consumer. It separately identifies opt-outs for targeted advertising, sale and specified profiling. Section 541.055 addresses agents for the statutory opt-out route. A controller must be able to verify identity and the agent's authority with commercially reasonable effort. That wording should not become an unconditional promise of agent-driven deletion. [8] [12] [9]
The Secretary of State maintains a searchable central Data Broker Registry under section 510.006. Registration is a way to identify registered brokers and their filed details. It does not establish that a particular consumer request reached a broker or that the broker completed it. The commercial controller, appraisal district and voter registrar remain separate recipients with different statutory records and response conditions. [13] [3] [6]
