Who and which information does chapter 92H cover?
Chapter 92H defines 11 covered-public-servant classes. They include specified executive officials, legislators, state and federal judges, court administrators, election-office employees or volunteers, and people designated for good cause by listed officials. Federal judicial coverage has a Hawaii residence or real-property connection. The family definition also has its own relationships. A general government-employment label cannot replace those statutory definitions. [4]
Protected personal information includes particular property-ownership and tax-record identity information, voter registration and absentee-ballot applications. The chapter's definition of home excludes investment property. The law addresses public Internet availability after a valid request, while preserving chapter 92F and other government-record access rights. Suppressing an online display therefore does not necessarily close the underlying record to every legally permitted requester. [2] [3] [4] [1]
Why do government and private requests differ?
A private-recipient request can come from the covered servant or an employer representative acting with written consent. Government requests must pass through the specified department head or court representative and identify each record or index. The government procedure also uses the statutory batch structure and exigency conditions. A single general notice should not be assumed to identify every government record requiring action. [6]
A valid request normally requires removal from controlled Internet or social-media sites within three business days. The chapter includes an extension procedure and substantive exceptions. Its exceptions address specified title-industry copies, government sharing, required public notices, news or public concern, voluntary publication and federal-law uses. The written request remains valid until written permission to release or the covered servant's death. [5] [10] [11]
Which voter and survivor processes are separate?
Hawaii Administrative Rules 3-177-159 permits confidentiality of residence address and telephone information for the stated good-cause circumstances. The application uses a sworn certification. Ordinary confidential registration lasts two election cycles, with reapplication unless the clerk waives it. The optional mailing address may be released for election or government purposes. Chapter 801G ACP participants present a current authorization card and follow a separate continuation rule. Their name, mailing address, actual address and telephone number must not appear in a list or register. The current rule does not retain the repealed ordinary-confidential-voter mail-only restriction. These procedures remain separate from chapter 92H's Internet-publication restrictions. [7] [8] [4] [1]
The Department of Law Enforcement's ACP requires contact with a designated application assistant at a certified victim-services organization. Applicants do not apply directly to the department. The published conditions include survivor status and a Hawaii residence unknown to the assailant, including the specified forthcoming-residence period. The separate security-breach statute reviewed for consumer privacy establishes notice duties, not an across-the-board finding about address deletion. [9] [12]
