# Home-address privacy in New Jersey, 2026

Last updated October 24, 2026

Daniel's Law uses different routes for private disclosure and government records. New Jersey's new 2026 data-broker registry also has an express delay before its registry subsection operates. [[1]](#source-1) [[2]](#source-2) [[3]](#source-3) [[4]](#source-4)

## Which records and offices are covered?

New Jersey record routes and their limits, checked October 24, 2026
| Record or recipient | Published mechanism | Important limit |
| --- | --- | --- |
| Private Daniel's Law recipient | An authorized person gives statutory written notice. | The reviewed provision allows 10 business days to cease disclosure or redisclosure. [[1]](#source-1)[[2]](#source-2)[[5]](#source-5) |
| Government record custodian | Use the separate Office of Information Privacy portal. | A government custodian is excluded from the private provision's definition of person. [[1]](#source-1)[[2]](#source-2)[[6]](#source-6) |
| Daniel's Law court status | The August 12, 2026 state-court holding removes a mental-state requirement for actual damages under section 166.1(c)(1). | The opinion leaves constitutionality to the Third Circuit. No later federal disposition was confirmed in this review. [[7]](#source-7) |
| ACP enrollment | Use an enrolling victim-service agency or participating private entity. | Program address substitution does not itself establish a property-record exemption. [[8]](#source-8) |
| Consumer-data agent | An authorized agent can exercise the specified opt-out rights. | The controller can verify identity and authority with commercially reasonable effort. [[9]](#source-9) |
| New data-broker registry | P.L. 2026, chapter 25 requires a public registry of brokers and data collectors. | Its registry subsection remains inoperative for 270 days after June 30, 2026. [[3]](#source-3)[[4]](#source-4) |

## Who and what does Daniel's Law protect?

The reviewed definition covers active, formerly active and retired judicial officers, law-enforcement officers, prosecutors and specified DCPP child protective investigators. It also includes immediate family members living in the same household. Several categories depend on nested statutory definitions. A job title alone does not settle coverage, and a relative's separate household cannot be assumed to satisfy the household requirement. [[10]](#source-10)

The private-recipient provision concerns a home address or unpublished home telephone number. After qualifying written notice, a person, business or association has 10 business days to cease disclosure or redisclosure. The reviewed government-record route instead uses the Office of Information Privacy portal. This distinction identifies the appropriate recipient before a person measures the response period or describes a request as complete. [[5]](#source-5) [[1]](#source-1) [[2]](#source-2)

## Which exceptions and other programs matter?

The private-recipient section excludes government record custodians from its definition of person and preserves specified professional, printed-news and telephone-directory exceptions. On August 12, 2026, the New Jersey Supreme Court held that actual-damages claims under section 166.1(c)(1) require no mental state. The court left constitutionality to the Third Circuit. This review did not confirm a later federal disposition. [[6]](#source-6) [[7]](#source-7)

New Jersey's Address Confidentiality Program follows a separate enrollment process through victim-service agencies or participating private entities. Its substitute-address mechanism should not be treated as a finding that deeds or ownership records become confidential. Voter information also has its own statutory protections for information supplied through the relevant victim process. The particular election provision governs that information rather than the private Daniel's Law notice deadline. [[8]](#source-8) [[11]](#source-11)

## What changed for consumer data and brokers?

The consumer privacy act's commencement clause is 365 days after its January 16, 2024 approval. Accounting for leap year gives January 15, 2025. The statute permits another person to serve as an authorized agent for specified opt-out requests. A controller's compliance obligation depends on commercially reasonable verification of both the consumer's identity and the agent's authority. [[12]](#source-12) [[9]](#source-9)

A separate enactment, P.L. 2026, chapter 25, was approved June 30, 2026. Section 2(b) directs Consumer Affairs to maintain a public registry of data brokers and data collectors. Section 8 expressly keeps that subsection inoperative for 270 days following enactment. This page therefore identifies an enacted registry requirement without claiming a live registry portal was verified on October 24, 2026. [[3]](#source-3) [[4]](#source-4)
