## Which records and offices are covered?

Colorado record routes and their limits, checked October 24, 2026
| Record or recipient | Published mechanism | Important limit |
| --- | --- | --- |
| State or local official's Internet records | The government request supplies protected status and a sworn imminent-threat statement. | Specified real-estate parties retain access to unredacted records. [[1]](#source-1)[[2]](#source-2)[[4]](#source-4) |
| Private Internet publisher | A qualifying written request identifies the publication and protected status. | The 2026 route requires removal within 72 hours and notice to the protected person. [[1]](#source-1)[[2]](#source-2) |
| ACP property records | Section 24-30-2108 excludes listed property-tax and recorded-document uses of the substitute address. | Section 18-9-313(2.5) provides a separate ACP Internet-removal request. [[5]](#source-5) |
| County voter office | A safety-based confidential-voter request uses the county clerk and recorder. | The published procedure includes a form and a $5 fee. [[6]](#source-6) |
| Consumer controller | The Colorado Privacy Act permits specified agent opt-outs and universal mechanisms. | Identity and authority authentication remain part of the agent rule. [[7]](#source-7)[[8]](#source-8) |

## Which version of the address law applies?

Section 18-9-313 defines protected persons through a detailed list of occupations and roles. The current definition includes judicial, education, healthcare, human-services, code-enforcement and other specified work. Election workers and elected officials also have distinct statutory sections. Those definitions are not interchangeable. A request needs the category and provision that actually govern the person and the publication. [[9]](#source-9)

The government-record request includes the person's full name, home address and evidence of protected status. It also requires the statutory sworn statement about an imminent serious threat. Specified real-estate participants retain access to unredacted records held by the clerk and recorder, assessor or treasurer. Government Internet removal therefore does not mean every copy of a property record becomes inaccessible. [[1]](#source-1) [[2]](#source-2) [[4]](#source-4)

## What did the 2026 amendment add?

HB26-1422's reviewed amendments became effective June 2, 2026. The private-recipient route in subsection (2.9) differs from the threat-based criminal prohibition. A qualifying written request identifies the publication and protected status and uses certified or electronic mail. The recipient must remove the covered information within 72 hours and notify the protected person. The request's statutory requirements remain necessary. [[3]](#source-3) [[1]](#source-1) [[2]](#source-2)

The Address Confidentiality Program has a separate property limitation. Section 24-30-2108 excludes property-tax listing, appraisal, assessment and collection, and documents recorded with a county clerk and recorder, from substitute-address use. Section 18-9-313(2.5) supplies an additional ACP Internet-removal mechanism. Enrollment through an Application Assistant should therefore be distinguished from completing the relevant property or publication request. [[5]](#source-5)

## Which voter and commercial routes are available?

Colorado's election guidance describes a county confidential-voter process for someone who believes public voter information exposes the person or household to criminal harassment or bodily harm. The published procedure calls for visiting the county clerk and recorder, completing a form and paying $5. Ordinary voter-file access and fields that are confidential for every voter remain separate questions in the same guidance. [[6]](#source-6)

The Colorado Privacy Act separately provides deletion and specified opt-out rights for covered consumer data. A consumer can authorize another person to exercise listed opt-outs, subject to commercially reasonable authentication of identity and authority. The universal opt-out mechanism requirement began July 1, 2024. Those commercial rights do not replace the request addressed to a government property custodian or county election office.
